Intellectual Property Policy

The website www.wocraft.com Held by High Digital Solutions is a creative platform for artisans, artists and designers. 

Respecting the intellectual property rights of our Members is at the heart of our priorities and we take infringements that constitute infringement very seriously. 

Counterfeiting means, in particular, the fact of reproducing, imitating, using or copying, in whole or in part, and without authorization , a creation protected by a design and model or a work protected by copyright or by a related right, a trademark, or an invention protected by a patent. 

Also, we ensure that the rights of our Members are respected on our Platform. 

In our capacity as a host within the meaning of the law for confidence in the digital economy ("LCEN" - Law n°2004-575, June 21, 2004), we bring to your attention how violations relating to the content of the Platform and how we deal with these notifications.  

Our policy is thus in line with the law for confidence in the digital economy and the law for a digital Republic (Law n°2016-1321, October 7, 2016).  

Reporting Intellectual Property Infringements 

If you believe that content published on the Platform infringes your intellectual property rights, you can send us an email at the following address: info@wocraft.com 

Notification of an infringement of intellectual property rights may be made by the owner of the rights or his duly authorized representative. 

Your email must contain the following information (LCEN, art. 6, I-5°): 

  • The date of notification
  • If the notifier is a natural person: You will indicate your surname and first name, profession, home address, nationality, date and place of birth.
  • If the notifier is a legal person: You will indicate its legal form and its corporate name, the address of its registered office and the identity of its legal representative.
  • The description of the disputed facts and their precise URL address on the Platform. 

You will send us a precise description of the situation and a screenshot of the page(s) where the content infringing your rights is published (the URL of the page must be visible each time). You will also indicate the URL addresses to facilitate our access to the said pages. - The reasons for which the content must be removed, including the mention of the legal provisions and the justifications of facts. - A copy of the correspondence sent to the author of the contentious information or activities requesting their interruption, withdrawal or modification, or justification that the author could not be contacted. 

All of this information is necessary for us to process your report. Our responsibility cannot be engaged in case of non-processing of an incomplete request. 
 

Notification processing 

Once your notification has been received by our team, we will remove or disable the offending pages or content. 

We will try to contact the author of the violation of your rights in order to inform him of your notification and allow him to provide elements of response. In this context, we may be required to send him a copy of the notification.  

False or abusive notification - We draw your attention to the fact that notifying WOCRAFT of a content or activity as being illicit with the aim of obtaining its withdrawal or stopping its distribution, knowing that this information is inaccurate, constitutes criminal offense punishable by imprisonment for one year and a fine of €15,000 (LCEN, art. 6, I-4). 

We also reserve the right to terminate your Seller account.  

Disagreement with the notification - If you yourself are the subject of a notification and you disagree with it or wish to obtain clarifications, you have the option of contacting its author (the contact details will be communicated to you by our team) or be assisted by the person of your choice if you wish to be advised. 

Infringement of another creator's intellectual property rights 

The proven violation of the intellectual property rights of a creator present on our site will result in the immediate and definitive closure of the account of the Seller at the origin of this violation.
