Preamble
WOCRAFT is an online sales platform, accessible from the website www.wocraft.com , a service offered by HIGH DIGITAL SOLUTIONS LTD.
Our Site allows sellers (hereinafter referred to as "Sellers") to connect with buyers (hereinafter referred to as "Buyers"). At WOCRAFT, our ambition is to promote know-how and artisanal products all over the world, as well as all creative and artistic fields.
Our site is a market place for handmade and crafts, and offers the sale of creations made in a traditional way and in small series by Sellers. Vintage or "Vintage-style" products are also on sale in the category provided for this purpose. Finally, the Platform also offers for sale creative supplies and haberdashery items in the most varied fields.
These general terms and conditions of use (hereinafter the "GTU") govern access to and use of the Platform and describe the conditions under which WOCRAFT offers access to its services through the Platform.
The T&Cs apply without restriction or reservation to any User of the site and associated services, whether or not they have opened an account. They apply under the same conditions to all sales made on the www.wocraft.com website , hereinafter "the Platform", between the Seller and the Buyer.
Our documents “ Site rules ”, “ Personal data policy ” and “ Intellectual property policy ” supplement these T&Cs or specify their terms, and are incorporated by reference into these T&Cs.
We strongly advise you to read all of these documents with contractual value before using the Platform.
Article 1. Definitions
"Buyer": designates any User of the Site that he intends to buy or that he has already purchased Products from the Sellers on the Site.
"Customer Account": refers to the personal space made available free of charge to the Member so that he can benefit from the Services.
"General Conditions of Use" or "CGU" : refers to these general conditions of use of the Services offered by WOCRAFT, accessible on the Site.
"Content(s)": means any content provided by a Member and published on the Site such as product, name, pseudonym, sign, data, information, text, description, image, photograph, sound file, video, logo, and in general, any other element provided by the Member on the Platform, whether at the registration stage, in an electronic message, on a Seller's store or by any other means not specifically referred to here.
"Member": designates any person registered on the Site, whether Buyer, Seller, or both Buyer and Seller, and who has a named Customer Account as such.
"Platform": refers to the functional and organizational structure of our WOCRAFT website allowing the connection of Sellers and Buyers of Products, accessible through the Site.
"Electronic Wallet": designates, for Sellers, the reserve of virtual money available in an account opened in their name when they have made at least one sale on the Site. This electronic purse allows them to be paid by Buyers, to make refunds after a total or partial cancellation of an order, and to collect the balance, net of WOCRAFT' commission.
"Product(s)": refers to any product offered for sale on the Platform by a Seller, whether they are artisanal creations, Vintage products, creative supplies or haberdashery items. The Product must comply with these T&Cs and not constitute a Prohibited Product.
"Prohibited Product(s)": refers to a Product whose sale on the Site is strictly prohibited on the Site and defined more particularly in Article 5 hereof (paragraph "Products offered for sale on the Site" ) and in the appendix to these T&Cs "The rules of the Site" .
"Service(s)": refers to all the services offered by WOCRAFT as described in article 3 of these T&Cs.
“Site”: designates the site accessible at the following address: https://www.wocraft.com (or any additional address or site that could be substituted or added to it) and which allows you to benefit from the Services from the Platform.
"User": designates any person using the Site, in any capacity whatsoever, whether or not they are registered as a Member.
"Seller": designates any person who has opened a virtual store on the Site and offers Products for sale.
Article 2. Scope of the T&Cs
These T&Cs tend to define the terms and conditions under which HDS makes the Services available to Users of the Site and the terms under which they access and use them.
The T&Cs apply without restriction or reservation to any use of the Site and the associated Services.
Any User of the Site acknowledges having read and accepted these T&Cs and having received the necessary information concerning the Services offered.
The T&Cs are the property of HDS. Any reproduction, even partial, is strictly prohibited.
The T&Cs may be adapted over time, without notice, in particular to adapt them to changes in the Services offered or in legislation. The modifications will then be enforceable against the Users as soon as they are put online, the subsequent use of the Services being worth recognition and acceptance of the modifications made.
Article 3. Presentation of the services and obligations of WOCRAFT
HDS aims to promote craft and artistic creations, and craftsmanship in general. For this, HDS provides its WOCRAFT Platform, accessible on the www.wocraft.com website , which is a space for connecting Sellers and Buyers.
In this context, WOCRAFT:
- Allows Users to consult the sheets of Products offered for sale on the Platform either by browsing the categories created on the Site, or by carrying out a search using keywords in the search bar provided for this purpose at the top of each page of the site ;
- Offers the possibility to Users to create a Customer Account in order to be able to proceed with the purchase of one or more Products after having, or not, contacted the Seller for more information;
- Offers Members the possibility of becoming a Seller by creating a virtual store on the Platform allowing them to present and sell their Products;
- Provides Sellers with tools to manage their virtual store (management and marketing tools) and to promote their Products.
WOCRAFT limits itself to connecting Buyers and Sellersand does not intervene in any way in the transactions they carry out on the Platform, on their own initiative and under the conditions that they set alone. WOCRAFT is therefore neither the owner, nor reseller, nor warehouse keeper, nor in simple possession of the Products offered on the site. WOCRAFT never intervenes, in any capacity whatsoever, in the manufacture, marketing or distribution of the Products (including verification tests, packaging, labelling, transport or any other related complementary or ancillary activity ). Having no control over the Products, the User is perfectly informed that the sale in which he intervenes, whatever its quality, is directly and exclusively under the personal responsibility of each party to the operation, excluding WOCRAFT.
WOCRAFT and the Members being independent parties, it is expressly stipulated that these T&Cs do not create between them any relationship of subordination, mandate, de facto partnership or partnership, or any other legal relationship than that defined in these T&Cs.
WOCRAFT is authorized to promote all or part of the Products offered for sale on the Platform by the Sellers, in particular by sending advertising e-mailings, publishing content in various media (press, radio, television, etc.). ) or social networks, the establishment of partnerships with other companies or websites, this list not being exhaustive. WOCRAFT will retain its role as intermediary and cannot be considered to go beyond this role by promoting the Products offered for sale on the Platform.
Furthermore, unless there is a public order rule to the contrary, each Member releases HDS from any liability in the event of a dispute or litigation between Members resulting directly or indirectly from the use of the Platform. Sellers are also clearly aware that WOCRAFT cannot guarantee that their Products will be sold on the Site, that the orders they may receive from Buyers will not be canceled or the Products returned after a purchase.
Finally, as a site publisher within the meaning of the law for confidence in the digital economy, HDS does not control the information provided by Members and made public on the Platform. In the event of Content that is offensive, harmful or constitutes a violation of intellectual property rights, or even penalized, we invite you to alert us by following the procedure described in article 13 "Confidentiality and respect for the person - Notification" .
Article 4. Obligations of members
USE AND REGISTRATION
To access the Platform, each User can visit the different pages and products, but to place an order he must first register. He then becomes a Member of the Platform.
Registration is only open to natural persons over the age of 18 and to legal persons (companies, associations, EIG), it being specified that, for the latter, registration can only be made by a person who has validly the power to hire him (chairman, manager, authorized person).
Registration allows the Member in particular to search for and consult Products offered for sale on the Site, to interact with the Sellers present on the Site, and to place an order for Products with the Sellers.
CREATION OF A MEMBER ACCOUNT
To create an account, anyone wishing to register on the Site as a Member must provide accurate, complete and sincere information, the list of which is indicated on the registration form created for this purpose on the Site.
Each Member undertakes to update this information as necessary, and is solely responsible for the consequences that may result from the provision of incomplete, incorrect or obsolete information to WOCRAFT or to another Member.
When registering, the Member informs in the form provided for this purpose his identity and his email, and defines his password. He undertakes to create only one account on the Site, to use his own identity and to keep the username and password he has chosen strictly confidential. To validate his registration, the Member must have read and accepted these General Conditions and the personal data policy.
The Member uses the Site in compliance with the laws and regulations in force, and with these General Conditions of Use and their appendices. He undertakes to act in good faith and with respect in his relations with other Members and HDS.
WOCRAFT reserves the right to terminate without notice the account of any person who does not comply with the above.
CONTENTS
The Member is informed that any Content published on the Site may be seen by any User of the Site.
The Content published on the Site remains the property of the Member. However, the latter expressly acknowledges and accepts that as long as he remains a Member of the Platform, he grants free of charge to HDS a non-exclusive and non-assignable or transferable license on them, for the whole world, to use, publish, reproduce, represent, make available, communicate, modify or adapt, on the Site but also on any sales or communication medium, for the needs of the company, for advertising, promotional, marketing, internal or external communication purposes or in as part of a commercial partnership with a third party for the purpose of promoting the Platform and its services. This right will end at the end of a period of 6 months running from the date of the Member's unsubscription.
Each Member, whether Buyer, Seller, or both, is solely responsible for what he publishes as content on the Site. Since WOCRAFT is an intermediary, it is not possible for it to control all of the Content posted online by its Members continuously.
Also, each Member refrains from any behavior that could infringe the rights of third parties, in particular their intellectual or industrial property rights, in any way whatsoever.
Any Member is prohibited from acts or actions:
- Tending to circumvent a paid Service of the Platform;
- Violating the intellectual or industrial property rights of a third party;
- Tending to obtain the payment of a sum of money without providing in return a Product presented and paid for on the Site;
- Inaccurate or tending to mislead;
- abusive, denigrating, libelous or defamatory;
- Obscene or pedophiles;
- Invading the privacy of a third party;
- Discriminatory, inciting violence or racial or religious hatred;
- Sentenced by the Penal Code and constituting embezzlement, breach of trust, fraud, this list is not exhaustive;
- Which could engage the civil liability of HDS or damage its image or reputation, or constitute unfair or parasitic competition with regard to it or that of a Member or a third party;
- Misappropriation or attempted misappropriation of Buyers or Sellers, or incitement of the latter to no longer buy or sell on the Platform, and in general any act of unfair competition, parasitism or nuisance with regard to HDS, the Platform, a Member or a third party.
In the event of non-compliance by the Member with the foregoing, the latter shall be solely responsible for the consequences that may result therefrom with regard to other Members, third parties and HDS.
In addition, HDS reserves the right to modify, deactivate or delete any Content that does not comply with these General Conditions and to suspend or close the account of the person concerned, without notice, notification or any compensation to the Member concerned.
USE OF THE SERVICES AND THE SITE
The Member undertakes to use the Services and the Site for exclusively and strictly personal purposes, and in accordance with their purpose. The Member undertakes never to interfere, in any way, with the operation of the Site and the Services offered.
Any publication, distribution, reproduction, representation, modification or extraction of the Site or Services is strictly prohibited and will systematically be the subject of legal proceedings.
Article 5. Obligations of sellers
The Platform allows Members registered on the Platform to sell their Products by opening a virtual store on the Site www.wocraft.com .
PEOPLE WHO CAN BECOME SELLERS ON THE PLATFORM
Only persons acting in a professional capacity can become Sellers on the Site .
Have the quality of professionals, natural or legal persons registered with the Chamber of Trades and Crafts, the Trade Register, autoentrepreneur and companies.
The proof to WOCRAFT of the status of Professional Seller is made during the request for activation of the virtual store, by uploading the documents requested in the form provided for this purpose.
TERMS OF ACTIVATION OF THE WOCRAFT SHOP
Each Member has a shop activation button in his Customer Account, which leads to a specific registration form.
In this form, the Member indicates the name he chooses for his shop, defines the URL of his shop, the address and the description of the shop.
Store activation is subject to HDS approval after verification of Seller information. The Member is informed of the activation of his shop by email, and is then invited to configure his shop.
WOCRAFT Verification Gold may request other additional information in order to validate the identity of the seller.
Once the store is activated, the Member becomes a Seller.
HDS provides Sellers with:
- Management tools for their shop: creation of product sheets; adding photos and video; creation of combinations; shipping profile management; personalization of shop pages and professional profile…;
- Tools for monitoring their activity: monitoring of orders, sales, followers, store visit statistics and product sheets, etc.;
- Promotional tools: discount voucher, promotions, visuals in free license.
PRODUCTS FOR SALE ON THE SITE
The products that can be put up for sale on the Site are handcrafted creations, made in single pieces or in small series; all products relating to creative supplies and haberdashery (artisanal or not); all Vintage products (artisanal or not) over 20 years old at the time of their sale, or products made "Vintage style".
Only "Authorized Products" may be offered for sale on the Site by Sellers. We invite each Seller to read in detail the appendix to these Terms of Use of the Site Rules by clicking on this link .
When posting its Products on the Site, the Seller understands that it must:
- Comply with the provisions of the Consumer Code in terms of informing the Buyer. He must therefore mention as accurately and precisely as possible: the essential characteristics of his Product in a sufficiently relevant description to ensure that the Buyer is fully informed, the quantity offered for sale, the price of the Product (including the VAT if the Seller is subject to it), the shipping time of the Product (time for preparation of the order), the delivery time if applicable, the delivery costs. It will also comply with the applicable labeling regulations concerning food products, textile products, footwear, cosmetic products, toys and childcare articles, and leather;
- Provide the necessary information in each Product sheet so that the Buyer is not misled by his offer. It will carry out all possible prior checks for this purpose. The Seller is solely responsible for all the information to be provided to the Buyer materializing his offer to sell a Product, in particular the description, the photos (at least 2 per Product, preferably on a white background), the characteristics of the Product, the different variations offered (colors, sizes, etc.);
- Fill in the information requested in the "SEO" tab of its Product sheets, accessible from its Seller space, in order to ensure proper referencing of its Products by internet search engines;
- Classify the Product in the appropriate category of the Site, and choose the sub-categories corresponding to its offer.
The Seller agrees not to offer for sale on his shop:
- One of the prohibited products listed here ;
- A product that does not correspond perfectly to the Product it has;
- A product that he is unable to deliver without delay, unless this delay is expressly indicated in the product sheet (in particular for customizable products or products made on demand, for which a manufacturing or personalization delay is necessary after placing the order);
- A product contrary to the regulations in force, morality or not authorized by HDS on its Platform;
- A product infringing the rights of third parties, in particular in terms of respect for the intellectual or industrial property rights of third parties, or in violation of a selective or exclusive distribution agreement.
- A product that does not comply with any legislation in force relating to safety and public health, consumer protection and consumer law in general.
We draw the Sellers' attention to the fact that they must strictly comply with the international laws and regulations applicable to them from the Product manufacturing stage until its purchase by a Buyer and that they remain solely responsible for the consequences. may result.
The Sellers undertake in this respect to implement any necessary control and verification action and to be able to justify it at any request from a competent authority (in particular with regard to toys, childcare articles, food products, cosmetic or personal hygiene products, textile or leather articles).
In addition, any Seller is prohibited:
- To include in its Content words infringing the rights of third parties, and in particular their intellectual or industrial property rights;
- To refer in any capacity whatsoever to the store name or the personal name of another Member in the Content that they publish on the site;
- To include in any place whatsoever on the Site (product sheets, shop profile, Seller profile, exchange of correspondence with a customer who started from the Site, etc.) all or part of a URL address or a name of domain outside the Site, or the name of a direct competitor of WOCRAFT;
- To evade unfairly, in any way whatsoever, a Service subject to remuneration on the Platform.
In the event of non-compliance with the foregoing, HDS may withdraw from sale any Product that does not comply with these general conditions, suspend or definitively close the account of the Seller concerned depending on the seriousness of the facts of which WOCRAFT will be the sole judge, and communicate, if necessary, all the facts observed on the Site to the competent authorities who will request it.
HDS recalls that there are specific regulations regarding the manufacture, marketing and sale of certain products, in particular for the following products:
- Toys and childcare articles,
- Foodstuffs,
- Cosmetics and personal hygiene products,
- Textile or leather articles,
- Electrical appliances…
The Seller shall remain solely liable vis-à-vis the Buyers, WOCRAFT or any third party, for the damage caused by its Products and, in general, for all the consequences that may result from the sale or offer of his products.
WOCRAFT will be held responsible, in any capacity whatsoever, for the Seller's activity; in the event of a complaint, action or claim by a third party against WOCRAFT (HDS), the Seller undertakes to indemnify HDS for all the consequences related to the non-compliance of its Products with the regulations in force or with a failure to sell or offer its Products. The Seller will financially support the payment of all sums, legal and lawyer's fees, convictions and all that may be due in this respect and undertakes to reimburse on first demand all sums that HDS may have otherwise exposed in this framework.
Confidentiality: The information relating to a Buyer to which the Seller has had access (surname, first name, address, email, telephone number in particular) will remain strictly confidential. The Seller undertakes not to disclose them, nor to use them, other than for the execution of the order and within the framework of these General Conditions. The Seller is prohibited from offering the Buyer Products that would be for sale on websites other than www.wocraft.com, nor from using the Buyer's personal data for purposes other than those referred to herein. -before. In the event of non-compliance with the above, WOCRAFT reserves the right to permanently close the store of the Seller concerned.
CONTACT WITH BUYERS
In order to protect consumers in their purchasing process and allow them to ask Sellers questions about the Products and other essential information, the Site allows Buyers to ask their questions directly to Sellers through the messaging service accessible from each Product sheet, each store and Seller profile page ("Contact the seller" button).
The contact between Buyer and Seller must be cordial. The Seller will respond to requests for information made to it within a maximum period of 48 hours upon receipt of the request. His answers will be as objective and fair as possible so that the Buyer gives his informed consent when validating an order.
RECEIPT OF AN ORDER
In order to ensure the reliability and reputation of the Site, the Seller undertakes to validate orders for Products within a maximum period of 48 hours from their receipt. This validation is materialized by the passage of the order to the order status "in preparation" in their shop manager.
If the Seller is unable to honor an order and deliver a Product ordered within the announced deadline, he undertakes to send the Buyer and WOCRAFT a cordial response and offer him a solution (total refund or replacement of Product, the Buyer deciding alone on the solution to be provided).
HOLIDAYS
In order to ensure the good continuity of the Service, the Seller who is absent for more than 2 consecutive working days must activate the “on vacation” mode in his shop manager accessible from his Customer account (Shop settings => Vacation mode).
The activation of a holiday period makes it possible to display a message for the attention of Users on all of the Seller's Product sheets as well as on his profile page. The Seller chooses whether he wishes to continue to receive orders during this period (taking care to indicate in his message of absence on which date he will then be able to process orders received in his absence) or, on the contrary, to he wants the order to be blocked until his return.
COMPLIANCE WITH CURRENT REGULATIONS
Professional Sellers undertake to comply with all the laws and regulations applicable to them in this capacity, and more particularly with regard to:
- consumer law;
- commercial law;
- Tax and social law;
- competition law;
- The legislation applicable to balances.
DISPUTES
Each Seller certifies by accepting these T&Cs that he can validly sell Products on the Site and guarantees WOCRAFT against any risk of claim from a third party relating to its offers of Products or the execution of a sale.
In the event of behavior by a Seller likely to harm the proper functioning of the sales process on the Site or to damage the image or reputation of WOCRAFT, in the event of consecutive negative evaluations and/or comments, repeated disputes with one or more Buyers, WOCRAFT may sanction the Seller under the conditions provided for in article 10 "SUSPENSION AND DELETION OF ACCOUNT".
In the event of a dispute between Sellers, it is their responsibility to resolve it between themselves without having to refer to WOCRAFT. However, if a Seller notices that another Seller is infringing its intellectual property rights, the injured party must follow the procedure described in our " Intellectual Property Policy " and contact WOCRAFT through this means.
INACTIVE SELLER ACCOUNT
The Seller is warned that if his account remains inactive for at least 3 consecutive months , his shop will be deactivated and no purchase will be possible on it.
For a period of 3 months beginning on the date of deactivation by WOCRAFT of the Seller's shop, the Seller will have the possibility of requesting the reactivation of his shop by email addressed to support@wocraft.com . He will also have the possibility of recovering the financial balance of his Electronic Wallet which would still be available relating to his orders paid for and delivered to Buyers.
At the end of this 3-month period, the store will be permanently deleted from the Site. The Product pages of the Seller's store will be removed from the Site, which will lead to their delisting in search engines. The unclaimed financial balance will be acquired by WOCRAFT and these general conditions will be terminated with respect to it.
Article 6. Obligation on buyers
A Buyer can only create one account on the Site. This account allows him to buy the Products offered for sale by the Sellers and to access all the Services offered on the Site.
Before confirming his order and paying for it, the Buyer checks the details of the items in his basket and in particular the price to be paid, the delivery method chosen, the delivery and billing addresses. He also checks that his contact details are correct (surname, first name, telephone number if necessary). He will show his acceptance of the order by proceeding to the payment, after having ticked the box of acceptance of the General Conditions and the Personal Data Policy of WOCRAFT and of the seller(s) concerned by the order.
By placing an order on the Site, the Buyer accepts that all the aforementioned elements will be communicated to the Seller for the purposes of the order.
The Buyer undertakes to respect the laws and regulations in force on the date of his purchase.
If the Product(s) ordered are not received within 04 weeks from the date of shipment indicated in the customer account, the Buyer sends a complaint to the Seller by contacting him from his virtual store. After this period, the transaction is deemed perfect between the Seller and the Buyer if no complaint has been received by the Seller.
Article 7. Buying on the site
TO ORDER
To be able to buy, the person must be registered on the Site. The creation of the customer account can be done at any time until the validation of an order but before its payment.
Prior to the order, the Buyer will take note of the essential characteristics of the Product(s) in the Product sheets put online by each Seller. The Buyer ensures that the Product corresponds to his needs and that he is sufficiently informed of its use, before validating his order.
If necessary, the Buyer can contact the Seller through the messaging system set up on each Product sheet, each shop page and each seller profile page ("Contact the Seller" button). He is thus free to ask any question, or ask to clarify a doubt concerning the Product or the conditions of purchase and delivery. This contact between the Buyer and the Seller must enable the Seller to understand the Buyer's needs.
Each Seller undertakes to communicate to Buyers its general conditions of sale for the Products concerned. These are also displayed on the profile page of each Seller.
Being an intermediary between Buyers and Sellers, WOCRAFT does not intervene in Product orders. Members, Buyers and Sellers, will settle among themselves the details relating to a given order. WOCRAFT cannot be held responsible in the event of failure of an order, out of stock of a Product, or any dispute that may arise between Members.
The Buyer adds the Products he wishes to buy in a virtual basket by clicking on the "Add to basket" button present on each Product sheet. He is free to buy Products from one or more different Sellers.
The buyer can at any time add or remove Products from his basket, modify the quantity he wishes to order, until the validation of his order. The validation of the order is given by clicking on the button "Order with payment obligation". Prior to this, the Buyer will have:
- Checked the Products in his basket,
- Validated its delivery address and billing address,
- Validated the chosen delivery method,
- Checked the summary of his order,
- Accepted the general conditions of use and the personal data policy,
- Read the cancellation and return conditions of each seller.
A minimum shopping basket is provided on the Site: in order to be validated, an order must present a total amount (excluding postage) greater than or equal to €6 excluding VAT.
Once the order has been validated, the Buyer proceeds to pay for it.
Any validated order constitutes a firm and final sale to purchase the Products ordered.
Once the payment has been made and validated, Buyer and Seller receive an order confirmation email.
ORDER PAYMENT
Payment for an order is made by credit card: Visa, Mastercard, CB or PayPal.
Payment by credit card on the Site is protected by a remote payment security system, called "3D SECURE". 3D Secure payment is valid for payments by credit card, Visa, and Mastercard. It allows payment by authentication and guarantees the protection of confidential data and the security of transactions. The Buyer's identity and the validity of his bank details are verified by the bank before validating the transaction.
Stripe, our financial intermediary, manages payments on the Site. Stripe is an authorized organization holding an electronic money issuer license (EME).
ORDER DELIVERY METHOD
Each Seller defines in his shop manager one or more shipping profiles that he will associate with one or more of his Products offered for sale on the Site.
Each product sheet visible to Buyers includes:
- The delivery method offered
- The estimated delivery time
- The processing time of the order before shipment.
The Seller undertakes to offer at least one delivery method allowing the tracking of packages. He will keep all proof of delivery.
The Seller is solely responsible for the shipping and delivery of the order in view of the information communicated by the Buyer and the applicable legal provisions. He will take care of the packaging and packaging of the Products.
The Products ordered are shipped and delivered at the expense and risk of the Seller. The latter is solely responsible for the proper performance of the obligation to deliver the items ordered and WOCRAFT cannot under any circumstances be held liable in this regard.
Once payment for the order has been made and validated, the Buyer's contact details become accessible to the Seller. The Seller has 48 hours to confirm the order (order with the status "Processing"). He must then ship the order within a maximum period of 7 days, unless agreed by the Buyer for a longer period.
When he is ready to ship his order, the Seller changes the status of the order to "Shipped" and specifies the tracking number of his package, as well as the website allowing online tracking of the shipment.
Upon delivery, the Vendor will confirm that the Buyer has received the order (order with the status "Delivered").
The follow-up of the order can be carried out on the Site by the Seller and the Buyer through their respective accounts.
RECEIPT OF PRODUCTS
The Buyer communicates to the Seller a complete address and will indicate any information he deems useful to allow the perfect realization of the delivery. The Buyer will be solely responsible for the consequences of a delivery made to an incorrect address and cannot hold the Seller or WOCRAFT liable if an unauthorized third party intercepts or receives the package in its place.
Upon receipt of his order, the Buyer checks the condition of the package, its packaging and its contents. The absence of reservations written by the Buyer on the delivery slip is deemed to be a presumption of conforming delivery of the product(s) ordered. The Buyer is fully informed that taking physical possession of the package containing the order entails the transfer of the risk of loss or damage. The Seller declines all responsibility for damage to the products after delivery.
In the event of missing items or damage (damaged package, lost or damaged products), the Buyer will refuse the package or make the usual reservations on the delivery slip (indicating a handwritten note presenting the reservation on the package received). The Buyer will immediately notify the Seller of the situation, and in particular if the issue of reservations upon receipt was not possible (parcel delivered without signature in particular). We draw your attention to the fact that the general statements "subject to unpacking" or "subject to verification" are ineffective and are not accepted by insurance companies.
In the event of delay or loss of the package containing the Buyer's order, the carrier will be contacted by the Seller to find out the reason. The carrier's records will prevail between Buyer and Seller in the event of a dispute and will prevail over any other document.
ABSENCE DURING THE DELIVERY OF THE PRODUCTS
If the Buyer is absent at the time of delivery of the Products, he undertakes to pick up his order at the place indicated on the notice of passage which will have been left to him, and within the prescribed deadlines. In the event that the package is returned to the Seller, the delivery costs paid with the order will not be refunded and new delivery costs will be claimed for a reshipment of the order.
APPLICABLE TAXES
VAT : The prices displayed on our site include VAT when applicable to the transaction.
Sellers subject to VAT: Sellers subject to VAT indicate, for each Product for sale on the Site, the applicable VAT and its rate in the Product presentation sheet, so that the corresponding VAT is displayed in the Cart of the Buyer.
Sellers not subject to VAT or beneficiary of the exemption based on VAT: When the Sellers are not subject to VAT, they indicate in their Product sheets the absence of applicable VAT.
Sales delivered to a Buyer in another Member State of the European Union: Sales of goods to individuals are in principle subject to VAT in the country of departure of the package containing the order. However, if the amount of deliveries of goods made in another Member State for a calendar year exceeds a threshold set by each Member State (€35,000 or €100,000 depending on the case), it is up to the Seller to register at the VAT in the Buyer's country of delivery and to collect the VAT at the rate provided for by this State and to pay it back (To find out the thresholds set by each Member State: See the European Commission website ).

Sales delivered to a Buyer in a State outside the European Union: These sales are not subject to VAT in the Seller's country but may be subject to this tax in the country of delivery if this tax exists. The buyer will be responsible for paying the tax.
OTHER TAXES AND CUSTOMS DUTIES
When the Seller is located in a country other than that indicated by the Buyer for delivery, taxes or customs duties in addition to the sale price displayed on the Site may apply.
WOCRAFT and the Sellers are not able to determine these costs at the time the Product is put online or the order is placed. The Purchaser alone is liable for these taxes and customs duties. He is invited to approach the customs office on which he depends before placing an order if he wishes an estimate of their amount.
If the country of delivery of the order is a geographical area that is difficult to access, the Buyer will contact the Seller before placing an order on the Site in order to ensure that the delivery can be made under the best conditions for both parties.
ORDER AND SHOP EVALUATION
Buyers have the possibility to leave an evaluation on the Site either on the products purchased, or on the store, or both.
Writing a review on purchased Products is possible from the customer account either from the "My orders" section by entering each order with a "Delivered" status, or from the "My reviews" section.
The evaluation entails the recognition by the Buyer that the transaction between the Seller and him is perfect and then refrains from any subsequent complaint to the Seller.
Buyers also have the option of leaving a review on the Store itself, directly on the Seller's profile page.
Opinions left by Buyers are subject to control by WOCRAFT, which verifies that the comments comply with laws and regulations, do not present an offensive or defamatory nature, and generally comply with these T&Cs. After this check, the reviews are put online and appear on the presentation sheets of the Products concerned, as well as on the Seller's profile page.
Article 8. Complaint and right of buyers - Return and refund
CLAIMS AND WITHDRAWAL
The Buyer sends his complaints directly to the Seller, the exercise of his right of withdrawal and his requests for reimbursement, which will be managed exclusively between them, without WOCRAFT having to know about it.
A right of withdrawal will be exercised each time the Buyer wishes to cancel his order without having to justify any particular reason.
A complaint will be made when the Product received is damaged or damaged, in the event of an error in the preparation of the package (wrong size or color for example) and, in general, each time the Product received does not conform. to the order placed.
The Buyer is fully informed that the transaction will be deemed closed within 14 days of receipt of the order, unless a complaint or withdrawal is made by the Buyer under the conditions and deadlines set out below.
WITHDRAWAL
On the WOCRAFT Site, all Sellers are professionals. Also, any Buyer has the right to return a Product ordered on the Site, except in the following cases for which no return will be accepted:
- The Product has been made at the request of the Buyer or has been clearly personalized for him.
- The purchased Product is a deteriorating or perishable product. This category targets in particular food products with a near expiry date. The Seller will have indicated on the Product sheet concerned the absence of authorized returns and the Buyer will have been fully aware of this before placing an order.
- The Product purchased is an item which, for reasons of hygiene or health protection , cannot be resold without risk for the Seller. This last category targets in particular sealed cosmetic products, underwear and swimwear. The Seller will have indicated on the Product sheet concerned or in its general conditions of sale (accessible on its profile page) the absence of authorized returns and the Buyer will have been fully aware of this before placing an order.
The Buyer who wishes to exercise his right of withdrawal and return his Product has a period of 14 days running from the day after receipt of his order (if this period expires on a Saturday, a Sunday or a public holiday, it is extended until the next business day). After this period, no return request will be accepted.
To exercise his right of withdrawal, the Buyer contacts the Seller by post (at the address indicated on the page of his shop or at the address that the Seller will have sent him) or by courier from our site (click on the "Contact" button located on any product page of the Seller, from the page of his shop or his profile). The Seller will then indicate to the Buyer how to return the Product and will indicate the carrier who will take care of the delivery. COMPLAINT
The Buyer who wishes to make a complaint about the nature, condition or quantity of the items received must be made to the seller by post or email within 72 hours of receipt of his order (if the expiry of the 72-hour period falls on a Saturday, a Sunday or a public holiday, this period is postponed to the first following working day).
Any complaint must imperatively be detailed and indicate the surname, first name and address of the Buyer, as well as the number of the order concerned; it must state clearly and in detail the grounds for the complaint. Without this information, the complaint cannot be processed as long as the customer has not satisfied these terms, and this in compliance with contractual and legal deadlines. The customer who lodges a complaint can withdraw it at any time, as long as the products have not been returned. Any withdrawal of a claim is final and makes it impossible to file a new claim for the same product.
If the Seller considers that the complaint is justified, he offers the Buyer a refund of his order (shipping costs included). The Buyer acknowledges that the refund is worth full compensation for his loss and that he cannot claim any other compensation. In the event of a dispute between Buyer and Seller on the merits of the complaint, WOCRAFT Customer Service will do its utmost to reach an amicable agreement. We advise the Buyer to take any useful photo or video so that we can intervene effectively. In the event of an abusive complaint, WOCRAFT reserves the right to refuse any subsequent order.
HOW TO RETURN AN ITEM ?
The Product(s) must be returned in their original packaging and must not have been worn, washed or used in any way. The Sellers check the returned Products and validate or not the Buyer's request. Any product that has been used or damaged under the responsibility of the Buyer will not be taken back, exchanged or refunded. In this situation, the product may be returned to the Buyer, at the latter's expense, without the Buyer being able to demand any compensation or right to reimbursement.
RETURN COSTS
The return costs are in principle the responsibility of the Buyer. However, in the event of an error in the preparation of the order or of a product defect, the Seller alone will bear the return costs and will specify to the Buyer the carrier chosen to carry out the return. We draw the Buyer's attention to the fact that if the product is lost by the carrier when returning the product, the Buyer remains solely responsible and cannot claim any reimbursement of the return costs or the amount of the returned products.
BUYER'S REIMBURSEMENT AMOUNT AND TIME
The amount refunded to the Buyer corresponds to the amount paid on our Site, i.e. the price of the returned item plus the corresponding shipping costs. On the other hand, the return costs remain the responsibility of the Buyer. The refund will be made within a maximum period of 14 days from receipt of the package by the Seller, and insofar as the return complies with the procedure defined in this article (in particular with regard to the condition of the returned items). The method of reimbursement used will be the same as that used for the payment of the order.
Article 9. Financial provisions for sellers
WOCRAFT COMPENSATION
The creation of a shop as well as the posting of the Products by the Sellers on the Site www.wocraft.com Are totally free. WOCRAFT is remunerated on the connection between the Buyer and the Seller and receives a commission in the form of a percentage of the amount of orders validated on the Site. Our commission is added to the sum of each product, which allows sellers to receive the amount they entered when adding the product.
COMMISSION AMOUNT
In return for putting them in touch with Buyers authorized by WOCRAFT, the Seller agrees to remunerate this service by way of a commission on its sales. WOCRAFT. receives a commission of 10% added to the amount of each product. WOCRAFT has the right to modify this commission at any time.
Article 10. Suspension and deletion of account
At any time, the Member who wishes to delete his Customer Account or close his shop must make a written request by email to support@wocraft.com . The deletion of the account or the store automatically entails the termination of these General Conditions without delay. In all cases where a Member does not comply with these general conditions, WOCRAFT. shall be entitled to suspend or terminate access to the Services after sending the Member an email explaining the reasons for the suspension or deletion of the account and allowing him to present his observations within 72 hours. This will be done without prejudice to the right to compensation that WOCRAFT may claim from the Member due to the offending behavior.
CLOSURE OF AN ONLINE SHOP
Closing a store does not automatically result in the deletion of the Customer Account, unless the Seller expressly requests it. In addition, WOCRAFT reserves the right to delete the online store of any Seller who has remained inactive for more than 3 months (absence of new products being put online or absence of an order received). Please refer to Article 5 for more details on this situation.
DELETE CUSTOMER ACCOUNT
WOCRAFT reserves the right to delete the account of any Buyer who remains inactive for at least 12 consecutive months. In this case, WOCRAFT will notify the Buyer in advance by email, and in the absence of opposition from the Buyer expressed within 15 days of receipt of said email, will definitively close his account. All data attached to this account will then be permanently lost.
Article 11. Duration and termination of the general conditions of use
These general conditions of use are concluded for an indefinite period.
WOCRAFT. reserves the right to modify them at any time without notice, to ensure the best possible development of the Services offered. If the Management of WOCRAFT deems that this modification constitutes a material change, it will inform the Sellers by e-mail to the address provided in their account.
Article 12. Intellectual Property
The WOCRAFT Marketplace is the property of HDS and is protected by international intellectual property laws and regulations. The general structure of the Services, the databases, texts, graphics, sounds, images, videos, and in general all the content present on the site and on the accounts on the social networks that it manages, are the property exclusive to WOCRAFT. Any total or partial representation or reproduction of this content, without the express and prior authorization of WOCRAFT or Hds is strictly prohibited and is likely to constitute an offense of counterfeiting. It is forbidden for the User, this list not being exhaustive, to carry out:
- Any use of the services, whatever its form, for the purposes of marketing, distribution, design or realization of a similar or equivalent service;
- Free of charge or against payment, any representation, distribution or marketing of the Services, or any use for processing, without express and prior authorization from WOCRAFT, subject to the reservations and limits set by it;
- Any direct or indirect use of the Services by rental, transfer or loan, even carried out free of charge, except with the express prior authorization of WOCRAFT;
- Any use of the databases of the WOCRAFT site, in any form whatsoever (extraction, storage, modification, etc.), or provision of the same elements for the benefit of third parties (rental or sub-rental, license or under license, assignment or transfer free of charge or against payment);
- The sharing, in any way other than those referred to in the previous point, of the WOCRAFT databases for a use other than that strictly necessary for the use of the Site.
In general, the User will respect the intellectual property rights belonging to WOCRAFT or for which the latter holds an operating license. Legal proceedings will be systematically initiated against any User who does not respect the above.
Article 13. Confidentiality, respect for the person - Notification
WOCRAFT undertakes to take the greatest possible care in preserving the security and confidentiality of the personal data of Users of the Site, as well as in respecting individuals and privacy. The Sellers who, because of their activity on the Site, collect the personal details of the Buyers, undertake to use them only for the sole purpose of processing the order and in compliance with these General Conditions.
When a User notices that the confidentiality of data is not respected on the Site, or when he considers that information or content published on the Site is erroneous, illicit, abusive, defamatory or discriminatory, he is invited to report it. Similarly, if a User is aware of Content that glorifies crimes against Humanity, incites racial hatred or violence, concerns child pornography, or violates human dignity, he is invited to notify WOCRAFT without delay. The notification takes the form of an email sent to contact@wocraft.com
or a postal letter addressed to the company's headquarters, in which the User will indicate his surname, first name, address, the description of the disputed facts and their exact location on the Site (URL address and screenshots). It will also indicate the reasons for which the Content must be removed, including the mention of the legal provisions and the justifications of facts. As far as possible, the User must send a copy of the correspondence addressed to the author of the disputed information or activities requesting their interruption, withdrawal or modification, or the justification of what the author could not be contacted. WOCRAFT will take all measures to put an end without delay to the facts denounced if they are founded.
Article 14. Liability
Due to its role as a simple intermediary, HDS cannot be held responsible for disputes arising between Members. Unless otherwise provided by law, each Member releases WOCRAFT (HDS) (as well as any corporate officer, officer and employee of the company) from any liability in the event of a claim, dispute and/or litigation between Members, and/or from any damage present or future, presumed or not, established or not, resulting directly or indirectly from this claim, dispute and/or litigation.
Moreover, being bound only by an obligation of means, WOCRAFT can only be held liable for direct damages which will be exclusively attributable to a contractual fault committed by it. On the other hand, it can in no way be held liable for any damage suffered by a Member or User in respect of the use of all or part of the Platform or the impossibility of using all or part of the Platform. Similarly, WOCRAFTne may be held liable for any malfunction, delay or interruption of access to the Internet network. As the host of the Content put online by its Members, WOCRAFT cannot be held liable for the Content published on its Platform.
Members are invited to alert WOCRAFT in the event of non-compliance with these T&Cs noted on the site, in particular in the event of the sale of prohibited Products, as defined in the appendix to these T&Cs " Platform rules " or non-respect of your intellectual property rights according to the procedure described in our "Intellectual Property Policy" .
Vis-à-vis Professional Sellers, WOCRAFTne may be held liable only in the event of fault attributable to it, and whatever the causes or circumstances. Compensation for damage suffered may not exceed the highest of the following amounts: 100 euros OR half of the commissions paid by the Seller concerned in the 6 months preceding the occurrence of the damage.
Article 15. Evidence
If necessary, the Users expressly accept that the production by WOCRAFT of the recordings on its servers relating to the use of the Platform, in particular the connection identifiers of the Members, shall prevail between the parties.
Article 16. Severability of the general conditions of use
If, for any reason whatsoever, one of the clauses of these T&Cs could not be applied, it would then be deemed unwritten, without causing the nullity of the T&Cs, nor altering the validity of its other stipulations.
